Shauna McClelland, expert employment lawyer in Christchurch

Shauna McClelland is a highly experienced and specialised employment lawyer who has practiced in employment law since her admission to the Bar in 1995. She initially commenced general practice with Joynt Andrews Barristers and Solicitors where she represented clients in relation to employment, commercial, family and criminal law matters, appearing in the District Court on a weekly basis. 

 

She was employed by the Canterbury Employers’ Chamber of Commerce as an Employment Lawyer from 1999 to 2011, advising and representing members of the Chamber in all aspects of employment law.   Shauna left the Canterbury Employers’ Chamber to become a Director of Goldstein Ryder McClelland, a boutique employment law firm advising and representing employees and employers. 

​During her career, Shauna has represented both employer and employee clients in all areas of employment law including significant experience in multi-union/multi-employer bargaining, collective bargaining, strikes and lockouts, change management and restructuring, enforcement of restrictive covenants, disciplinary investigations, performance management, management of medical incapacity, workplace stress, workplace bullying, sexual and racial harassment, personal grievances, human rights and privacy issues.  She has also appeared in the Employment Tribunal, Employment Relations Authority, Employment Court, District Court and High Court.  Shauna has recently been the Lead Advocate for the Employer Bargaining Side in relation to New Zealand’s first Fair Pay Agreement.

 

In 2013, Shauna established her own practice, again acting exclusively in the area of employment law and with a particular interest in independent investigations.  

 

Shauna has over twenty years’ experience in undertaking independent investigations, which places her amongst New Zealand’s most experienced employment law investigators.  Shauna has conducted numerous independent investigations since 1999.  Over the past few years and as the demand for independent investigations has increased, this work now makes up a significant proportion of her practice.

 

The nature of her work in this area includes:

 

  • Investigations into bullying, work related stress, sexual harassment and serious misconduct;

  • Multi complainant and multi respondent investigations;

  • Industry specific investigations (for example, multiple local government and health sector investigations, mining, transport sector and Not for Profit investigations);

  • Lengthy complex investigations with multiple reports.

 

She is a member of the Association of Workplace Investigators and attends their conferences and training events.  Shauna is a regular speaker at conferences and training events.
